Plain-Language Summary

These Terms of Service govern your use of the CG Fence website at cg-fence.ca and the relationship between you and us when you request information, ask for a quote, or otherwise interact with our online presence. They do not replace the written installation contract you sign when you proceed with a fence project — that contract is the document that governs the actual installation, pricing, schedule, and warranty.

By using our website, you agree to these Terms. Please read them carefully.

1. About These Terms

These Terms of Service (the “Terms”) form a legally binding agreement between you (the “User”, “you”, “your”) and Comfort Group (CG Fence Division), operating as CG Fence (the “Company”, “we”, “us”, “our”).

These Terms govern your use of the website located at cg-fence.ca and any related subdomains, pages, forms, and online tools (collectively, the “Website”). They also govern your initial engagement with us through quote requests, contact forms, and similar online interactions.

Important: These Terms do not constitute a contract for fence installation services. If you decide to proceed with a project, you and CG Fence will sign a separate written installation agreement (the “Installation Contract”), which will set out project specifications, price, schedule, warranty terms, and other project-specific provisions. In the event of any conflict between these Terms and the Installation Contract with respect to a specific project, the Installation Contract prevails.

2. Acceptance of Terms

By accessing or using the Website, submitting a quote request or contact form, or otherwise interacting with CG Fence online, you confirm that:

you are at least 18 years of age and legally capable of entering into binding contracts in the Province of Ontario;
you have read, understood, and agree to be bound by these Terms and our Privacy Policy;
any information you provide is accurate, current, and complete to the best of your knowledge;
you have the legal right to request fence installation work at the property address you submit (e.g., you are the property owner, or you have the owner’s authorization).

If you do not agree with these Terms, do not use the Website.

3. Services Overview

CG Fence is a residential fence design and installation company operating in the Greater Toronto Area, Ontario, Canada. Our services include:

Pressure-treated and Western Red Cedar wood fence installation;
Horizontal modern fence systems with steel posts;
Composite fencing (Trex, TimberTech, and equivalent systems);
AI-generated visualization previews;
Underground utility locate coordination through Ontario One Call;
Project management, milestone reporting, and warranty service.

We currently do not offer vinyl fencing, aluminum fencing, chain-link fencing, gate automation, commercial fencing, or deck construction. Service offerings may change. The list of services published on the Website at the time of your quote request governs.

4. Service Area

We provide services within the following Greater Toronto Area municipalities: Toronto, Oakville, Vaughan, Richmond Hill, Mississauga, Markham, Brampton, and Burlington. Projects outside these municipalities are accepted at our sole discretion and may be subject to additional travel charges, which will be disclosed in writing before any contract is signed.

5. Quote Requests and Estimates

5.1 Nature of Online Submissions

A quote request submitted through our Website is an expression of interest. It does not, by itself, create a contract or obligate either party to proceed with a project.

5.2 Preliminary Estimates

Any pricing range published on the Website (including the “starting from” prices per linear foot for various fence materials) is a preliminary indication only. Actual pricing depends on site conditions, materials selected, design complexity, removal of existing structures, soil conditions, accessibility, permit requirements, and other factors that can only be evaluated during an on-site measurement.

5.3 Site Visits

We aim to schedule a site visit within 3 to 5 business days of your initial contact. Site visits are typically provided at no charge within our service area for residential projects meeting our minimum project value.

5.4 Minimum Project Values

Minimum charge per project: CAD $2,500.
Minimum starting project value: CAD $3,000.

All pricing on the Website and in quotes is in Canadian dollars and is exclusive of applicable taxes (HST) unless otherwise stated.

5.5 Validity of Written Quotes

Written quotes issued by CG Fence are valid for the period stated on the quote (typically 30 days). After the validity period expires, pricing is subject to revision based on current material and labour costs.

6. AI Visualization Service

As part of our quote process, we may provide an AI-generated visualization showing an approximate preview of how your selected fence might appear at your property.

Visualizations are approximations. They are intended to illustrate general appearance and style. Actual installed results will vary based on site conditions, lighting, weathering, material variation, and other factors.
Not engineering drawings. Visualizations are not site plans, surveys, engineering drawings, or permit documents and must not be relied upon for those purposes.
Image rights. By submitting photographs of your property to us for visualization, you confirm that you have the right to share those images and you grant us a limited licence to use them solely for the purpose of preparing your visualization and project quote.
Delivery time. We target delivery of visualization renderings within 48 hours of a completed site visit, but delivery times are not guaranteed.

7. Underground Locates and Site Preparation

Before any excavation, Ontario law requires that underground utility locates be requested through Ontario One Call. We submit locate requests on behalf of our customers as part of our standard project process, typically at least five business days before scheduled work.

You agree to provide accurate property information, including any known underground structures, irrigation systems, invisible pet fences, low-voltage lighting wiring, or private utilities that are not covered by public locates.
CG Fence is not responsible for damage to undisclosed private underground systems if you have not informed us of them in writing before work begins.
You agree to provide a current land survey of the property where available, or to confirm property boundaries through other means acceptable to us. We are not responsible for fence placement disputes arising from inaccurate or absent boundary information.

8. Permits and Municipal Compliance

Some fence installations in the Greater Toronto Area require a building permit, particularly for pool enclosures, corner-lot fences, fences exceeding municipal height limits, and fences on properties subject to heritage or conservation designations.

CG Fence will identify when a permit is required and can, on request, manage the permit application process on your behalf for a separate fee disclosed in the Installation Contract.
Permit approval is granted by the relevant municipal authority, not by CG Fence. We do not guarantee that any specific permit application will be approved.
Where a permit is required, work will not commence until the permit has been issued.

9. Warranty

CG Fence offers a fifteen (15) year limited workmanship and structural warranty on completed installations, subject to the full terms set out in the written warranty certificate provided at project handover.

Manufacturer material warranties (for example, those offered by Trex and TimberTech for composite materials) are separate from the CG Fence warranty and are administered directly by the relevant manufacturer.
Wood is a natural material. Cosmetic variations including grain, knots, colour change over time, and minor surface checking are normal characteristics of wood and are not covered by the workmanship warranty.
Damage caused by ground movement, severe weather events, vehicle impact, vandalism, modifications by third parties, or failure to perform reasonable maintenance is excluded from coverage.

Full warranty terms, exclusions, and claim procedures are set out in the warranty certificate. The terms in the warranty certificate prevail over any general description on the Website.

10. Payment

Specific payment terms are set out in each Installation Contract. As a general practice:

a deposit is required to confirm scheduling and secure materials;
a milestone payment is typically due upon reaching 50% project completion, following customer approval of the 50% photo report;
final payment is due on completion, after the final walk-through and your written or photographic acceptance of the completed work.

We accept payment by methods specified in the Installation Contract. Late payments may be subject to interest at a rate disclosed in the contract.

11. Use of the Website

11.1 Permitted Use

You may use the Website for lawful purposes related to evaluating, requesting, or arranging fence services for properties you own or have authorization over.

11.2 Prohibited Conduct

You agree not to:

use the Website in any way that violates applicable laws or regulations;
submit false, misleading, or fraudulent information;
impersonate any person or misrepresent your affiliation with any person or entity;
attempt to gain unauthorized access to the Website, our systems, or any data not intended for you;
interfere with or disrupt the Website or its underlying infrastructure, including by introducing viruses, worms, or other malicious code;
use automated means (bots, scrapers, crawlers) to collect data from the Website without our prior written consent, other than search-engine indexing in accordance with our robots.txt;
reproduce, modify, distribute, or create derivative works from any portion of the Website except as expressly permitted in these Terms;
use the Website in any manner that could damage, disable, overburden, or impair our servers or networks.

12. Intellectual Property

All content on the Website — including text, graphics, logos, photographs, videos, project case studies, AI-generated visualizations created for marketing purposes, designs, and software — is owned by CG Fence, Comfort Group, or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

The names “CG Fence”, “Comfort Group”, and any associated logos are trademarks used by us in Canada. You may not use these marks without our prior written consent.
You may view, download, and print Website content for personal, non-commercial reference in connection with evaluating our services. Any other use requires our prior written consent.
Photographs of completed customer projects are used only with the property owner’s consent. If you are a customer and wish to revoke consent for the future use of project photographs, contact our Privacy Officer.

13. User-Submitted Content

When you submit photographs, descriptions, or other content to us through the Website or otherwise (“User Content”), you represent and warrant that you own or have the necessary rights to share that content with us. You grant CG Fence a non-exclusive, royalty-free licence to use, store, and process the User Content for the purposes of:

preparing your quote, design, and AI visualization;
communicating with you about your project;
maintaining our internal records.

We will not use User Content for marketing purposes (testimonials, before/after photography, social media) without your separate express consent.

14. Reviews and Third-Party Platforms

We may invite you to leave a review on Google, HomeStars, or similar platforms. Reviews are a voluntary expression of your honest opinion. We do not pay for reviews, and we do not provide compensation in exchange for positive reviews. Limited promotional offers in exchange for video testimonials may be offered to selected customers; any such offer will be disclosed in writing and is conditional on the testimonial being a genuine and honest reflection of your experience.

15. Disclaimers

The Website and any information provided through it are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law:

We make no representations or warranties of any kind regarding the operation of the Website or the accuracy, completeness, or reliability of any information on it, including pricing ranges, material availability, or scheduling timelines;
We do not warrant that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
Any links from our Website to third-party sites are provided for convenience only. We do not endorse and are not responsible for the content, practices, or privacy policies of third-party websites.

Nothing in these Terms limits or excludes any rights or remedies that cannot be limited or excluded under the Ontario Consumer Protection Act, 2002, or other applicable consumer protection legislation.

16. Limitation of Liability

To the maximum extent permitted by applicable law, CG Fence, Comfort Group, and our directors, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including damages for loss of profits, loss of revenue, loss of data, business interruption, or loss of goodwill — arising out of or in connection with your use of the Website, even if we have been advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with your use of the Website (and not in connection with an Installation Contract, which has its own liability terms) is limited to the greater of:

the total amount paid by you to CG Fence in the twelve months preceding the event giving rise to the claim; or
CAD $100.

This Section does not apply to liability for personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any liability that cannot be excluded or limited under applicable law.

17. Indemnification

You agree to indemnify and hold harmless CG Fence, Comfort Group, and our directors, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

your breach of these Terms;
your violation of any applicable law or third-party right;
your submission of inaccurate or misleading information; or
your misuse of the Website.

18. Privacy

Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in accordance with PIPEDA. By using the Website, you consent to the practices described in the Privacy Policy.

19. Termination

We may suspend or terminate your access to the Website at any time, without notice, if we reasonably believe you have violated these Terms or applicable law, or if we discontinue the Website. Termination does not affect rights and obligations that by their nature should survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution provisions.

20. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to its conflict-of-laws principles.

The parties agree to attempt in good faith to resolve any dispute arising out of or in connection with these Terms through direct negotiation before initiating any legal proceeding.

Subject to applicable consumer protection legislation, you and CG Fence agree that any unresolved dispute will be brought exclusively in the courts of the Province of Ontario, located in the Regional Municipality of Halton, and you and we consent to the personal jurisdiction of those courts.

Nothing in this Section affects rights you have under the Ontario Consumer Protection Act, 2002, including any right to bring a claim in small claims court or in the court of your home jurisdiction in Ontario where applicable.

21. Changes to These Terms

We may revise these Terms from time to time. The revised Terms take effect when posted on the Website, and the “Last Updated” date will be updated. For material changes, we will provide prominent notice on the Website. Your continued use of the Website after the effective date of a revised version constitutes your acceptance of the revised Terms.

22. General Provisions

Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and CG Fence regarding your use of the Website, and supersede any prior agreements with respect to that subject matter.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or otherwise by operation of law.
The parties have requested that these Terms and all related documents be drawn up in English. Les parties ont demandé que la présente convention ainsi que tous les documents qui s’y rattachent soient rédigés en anglais.
